Privacy policy statement on the use of personal data pursuant to Art. 13 of EU Regulation 679/2016/EU. a. Who we are: Genuiny LTD, 20-22 Wenlok Road, London, hereinafter referred to as Genuiny is the Data Controller that collects and processes the personal data provided with this form and, pursuant to Article 13 of the EU Regulation 679/2016/EU (hereinafter referred to as "the Regulation"), provides the following information: b. For what purposes we collect the data: the data you are providing by filling in this form, the compulsory data and, where applicable, the optional data, will be used for the following purposes: 1. (i) To enable you to collect 100% of the net profits generated by your Genuiny certified data (before disbursement, you must authenticate your Genuiny B.A.N. personal code and send a copy of a valid identity document). To enable you to purchase products and services, fulfil obligations and exercise rights arising from the contract concluded; (ii) to comply with legal, regulatory, EU, tax or accounting obligations (invoicing, bookkeeping and accounting entries); 2. Marketing, to contact you - by telephone, post, e-mail, sms, mms, app, push notifications, etc. - for advertising or commercial communications relating to the products and services you provide. - Marketing, to contact you - by phone, mail, e-mail, sms, mms, app, push notifications, etc. - for advertising or commercial communications relating to exclusive benefits that Genuiny and its Business Partners reserve for their members, as well as to know your level of satisfaction with our services. These communications may also be specially personalised if you have given your consent to the profiling referred to in point b) 2, and thus to analyse your consumption habits. c. How we process the data and the profiling logic used: the data will be processed in compliance with the regulations in force and, in any event, in such a way as to guarantee its security, confidentiality and to prevent its unauthorised disclosure or use, alteration or destruction. The data will be processed mainly by computer as well as for the purpose of conducting customer/supplier relations in order to grant discounts or promotions on the basis of spending volumes and to give you access to other benefits. In addition, the data provided and the data relating to purchases will always be analysed using automated tools (profiling programmes and behavioural analysis) in order to place you in specific consumption categories to send you offers that are more relevant to your consumption preferences and to allow us to adapt our commercial and promotional offerings, as well as in the case of consent to use the data for the purposes indicated in point b)3 to possibly send you promotions and/or discounts that may be of greater interest to you. d. Retention period: the data relating to purchases will in any case be retained for more than 10 years from the conclusion of the customer/supplier relationship or for any different period provided for by current legislation or provisions of the Guarantor for the purposes referred to in points b) 2, after which they will be destroyed or made anonymous, while for accounting purposes they will be retained for the period required by law. e. To whom we disclose the data: the data will not be disclosed or communicated to third parties. To enable us to manage your purchases and pursue the purposes to which you have consented, the data may be disclosed to: (i) companies that, on our behalf, perform the service of storage and processing of computer files; (ii) companies in charge of mailing and/or sending or shipping promotions and advertising or carrying out promotional activities (limited to name, surname and address for sending general mail; e-mail address for sending electronic mailing; telephone/cell phone number for tele-marketing activities) (iii) companies in charge of managing warehouse logistics, shipping of purchased products and related customer care activities. These subjects will act as external data processors pursuant to Article 28 of the Regulation. The data may also be communicated to credit institutions (to manage the payment of your purchases). Your data may be disclosed to the persons in charge and managers of Genuiny's Marketing, Information Technology and Customer Care Departments. f. The rights of the data subject and the possibility to lodge a complaint and contact details: In accordance with current legislation (Articles 15 to 22 of the Regulation), you have the right to obtain access to your information (Article 15), its rectification or integration (Article 16), its deletion (the so-called right to be forgotten, Article 17), and the restriction of its processing (Article 18) the right to the portability of your data (Art. 20), the right to object to the processing of your data for special reasons (Art. 21) and not to be subjected to an automated decision-making process (Art. 22); in addition, we remind you that you always have the right to lodge a complaint with the Data Protection Authority (www.garanteprivacy.it). You also have the right to revoke at any time, in whole or in part, your consent for the conduct of contact activities for advertising/promotional communications (purposes under b) 3). In this case, you will no longer be the recipient of any kind of communication, by any means, electronic or in paper form. If you wish, you may instead revoke your consent limited to the receipt of communications by e-mail, sms, mms, etc., continuing to receive commercial communications solely by paper mail or telephone contact with an operator, if any.

Use of our Services

You must not misuse our Services. For example, you may not interfere with our Services or attempt to access them using any method other than the interface and instructions provided by us. You may only use our Services in ways that are permitted by law, including applicable export and re-export control laws and regulations. We may suspend or terminate the provision of our Services to you if you fail to comply with our terms or policies or if we are investigating a case of alleged unlawful conduct. By using our Services, you do not become the owner of any intellectual property rights to our Services or the content you access. You may not use content from our Services without obtaining permission from the owner or where not permitted by law. These terms do not grant you the right to use any trademark or logo used on our Services. You may not remove, obscure or alter any legal notices displayed on or with our Services. Our Services display content that is not the property of Genuiny. Such content is the sole responsibility of the person who makes it available. We may reserve the right to review content to determine if it is illegal or contrary to our rules, and we may also remove or refuse to display content if we have reasonable grounds to believe that it violates our rules or the law. This does not necessarily mean that we review the content, nor can it be presumed. In connection with your use of the Services, we may send you service announcements, administrative messages and other information. You can turn off the sending of certain communications.

Your Genuiny account.

To protect your Genuiny account, you must keep your password confidential. You are responsible for the activity carried out on or through your Genuiny account. It is advisable not to reuse your Genuiny account password for third-party applications. If you become aware of any unauthorised use of your password or Genuiny account, report the incident by filling out the form on the contact page.

Privacy and copyright protection.

Genuiny's Privacy Policy explains how we treat personal information and protect your privacy when you use our Services. By using our Services, you agree that Genuiny may use such information in accordance with our Privacy Policy. We respond to notices of alleged copyright infringement and terminate the accounts of repeat infringers in accordance with the procedure set forth in the Digital Millennium Copyright Act. We provide information to help copyright holders manage their intellectual property online. If you believe someone is infringing your copyright and would like to report it to us, please fill out the form on the page.

User Content on our Services.

Some of our Services allow you to upload, transmit, store, send or receive content. You retain any intellectual property rights you may have in such content. In short, what belongs to you remains your property. When you upload, transmit, store, send or receive content from or through our Services, you grant Genuiny (and our cooperating partners) a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other modifications made so that the content works best with our Services), communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant under this licence are for the limited purpose of using, promoting and improving our Services and developing new services. This license continues even if you stop using our Services. Some Services may offer ways for you to access and remove content provided on that Service. In addition, some of our Services contain terms or settings that restrict the scope of our use of content submitted to such Services. You must ensure that you have the necessary rights to grant us this licence with respect to any such content.

Information on software in our Services.

When a Service requires or includes downloadable software, such software may automatically update on your device if a new version or feature is available. In some Services, it may be possible to change the automatic update settings.

Modification and discontinuation of the provision of the Services.

We are constantly striving to modify and improve our Services. We may add or remove functionality or features, and we may suspend or discontinue providing a Service altogether. You may stop using our Services at any time, although we will be sorry to see you go. Genuiny may also stop providing Services to you or establish new limits on access to the Services at any time. We believe that your data is your property and that retaining your access to such data is important. If we discontinue providing a Service, we will, where reasonably possible, provide you with reasonable notice and an opportunity to remove information from such Service.

Guarantees and Limitations of Liability.

We set a commercially responsible standard of competence and care for our Services and hope that you will enjoy using them. However, we cannot make any promises regarding certain aspects of our Services. Except as expressly set forth in these Terms or in the Additional Terms, neither Genuiny nor its suppliers or distributors make any specific warranties with respect to the Services. For example, we make no warranties about the content in the Services, the specific function of the Services or their reliability, availability or ability to meet your needs. The Services are provided on an "as is" basis.

Responsibility for our Services.

Where permitted by law, Genuiny and its suppliers and distributors shall not be liable for loss of profits, revenue or data, financial loss or indirect, special, consequential, exemplary or punitive damages. In any event, Genuiny and its suppliers and distributors shall not be liable for any loss or damage not reasonably foreseeable. We understand that in some countries you may have legal rights as a consumer. If you are using the Services for a personal purpose, nothing in these terms or any additional terms shall limit your legal rights as a consumer that cannot be waived by contract.

Corporate Use of our Services.

If our Services are used on behalf of a business, the business must agree to these terms. You shall indemnify and hold Genuiny and its affiliates, officers, agents and employees harmless from any claim, suit or action arising out of or relating to your use of the Services or your violation of these Terms, including any liability or expense arising out of claims, losses, damages, suits, judgments, court costs and attorneys' fees.

Information on these Terms.

We may change these terms or any additional terms applicable to a Service, for example to reflect changes in laws or our Services. You should consult the Terms regularly. We will post notices of changes to the terms on this page. Notice of any changes to the terms will be posted on the relevant Service. Changes will not be retroactive and will become effective no sooner than fourteen days after the date of publication. However, any changes related to new features of a Service or any changes made for legal reasons shall take effect immediately. If you do not accept the modified terms of a Service, please stop using it. In the event of any conflict between these terms and the additional terms, the additional terms shall prevail. These terms govern the relationship between Genuiny and you, and do not give rise to any third party beneficiary rights. If you fail to comply with these terms, our failure to take prompt action shall not be construed as a waiver of any rights we may have (such as the right to take action in the future).
